Terms of Service

The official terms governing use of our website and purchase or use of Win City Bins services.

Effective Date: July 20, 2026

These Terms of Service (“Terms”) are a legal agreement between you and Win City Bins LLC (“Win City Bins,” “we,” “us,” or “our”). They govern your use of wincitybins.com and your purchase or use of Win City Bins services.

Please read these Terms before registering for a free trial or requesting service. By submitting a service request, beginning a free trial, purchasing a plan, or allowing us to perform service, you agree to these Terms.

If you act for a property owner, HOA, company, property manager, vacation-rental operator, or another organization, you represent that you have authority to accept these Terms for that person or organization.

1. Our Services

Win City Bins provides trash and recycling bin valet and related property services. Depending on the selected plan or written proposal, services may include:

Moving eligible trash or recycling bins from their storage location to the curb or another designated municipal collection point;

Returning bins after the scheduled municipal collection;

Providing timestamped service photographs;

Handling reasonable gate and access instructions;

Handling qualifying overflow bags, flattened boxes, or miscellaneous items;

Cleaning or organizing the immediate bin area;

Providing one-time or customized service; and

Managing services for multiple properties.

Win City Bins does not operate the municipal or private waste-collection vehicles that empty the bins. We do not control whether a municipality, HOA, waste hauler, or recycling provider completes collection.

The precise services included in your plan are those displayed when you enroll or stated in an accepted written proposal.

2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering a contract to purchase service.

You represent that:

You own the service property or have the owner’s permission to order the service;

You have authority to provide access instructions and authorize personnel to enter the exterior areas reasonably necessary to reach the bins;

Information you provide is accurate and complete;

Your requested service does not violate a lease, HOA rule, municipal rule, or agreement with another party; and

You will inform us promptly of changes affecting service.

Our services do not authorize entry into an occupied dwelling or another non-public interior area unless expressly agreed in writing.

3. Free Trial

Eligible new customers may receive the free-trial period displayed on the website, currently two weeks.

Unless otherwise disclosed during enrollment:

No credit card is required to begin the trial;

The trial includes ordinary weekly bin take-out and return service within the limits of the selected or approved plan;

Eligibility may be limited by service area, route availability, property access, and prior trial use; and

A customer or property generally may receive only one free trial unless we approve otherwise.

A paid subscription will not begin unless the customer receives the applicable price and billing terms and affirmatively agrees to paid service.

We may end or decline a trial if the property is outside our service area, unsafe, inaccessible, unsuitable for regular service, or associated with suspected misuse of the offer.

4. Plans, Prices, and Paid Subscriptions

Current advertised residential plans include Starter, Premium, and Pro plans. Enterprise, portfolio, HOA, multi-property, one-time, overflow, and hauling services may use custom pricing.

Before charging you, we will disclose the applicable:

Plan or service;

Price;

Billing frequency;

Material service limits;

Trial or promotional terms;

Method for cancellation; and

Any additional recurring or one-time charge requiring authorization.

If you enroll in a monthly subscription, you authorize recurring monthly charges using the payment method you provide until the subscription is canceled or terminated.

Taxes and government-imposed fees may be added when legally required. Additional services, excess items, special hauling, repeated access attempts, or work outside the selected plan require your approval before an additional charge is imposed, except where a separately accepted proposal states otherwise.

We may change future subscription prices by providing advance notice. A price change will apply no earlier than the next billing period identified in the notice, subject to applicable law.

5. Cancellation and Refunds

The website advertises “No Contracts” and “Cancel Anytime.” You may request cancellation by contacting support@wincitybins.com.

Unless a different cancellation date is disclosed when you enroll:

Cancellation stops future renewal charges;

Service already completed is nonrefundable;

A partially used billing period is not prorated, except when required by law or expressly approved by Win City Bins;

Service may continue through the end of the paid billing period; and

A cancellation is effective after we have received and processed enough information to identify the applicable customer and property.

You should retain the cancellation confirmation. Billing disputes should be sent to billing@wincitybins.com promptly after the charge appears.

6. Scheduling and Municipal Collection

We schedule service using information from customers, municipalities, HOAs, waste haulers, and other reasonably available sources. You must provide accurate collection-day information and notify us of special or changed schedules known to you.

Municipal schedules may change because of holidays, weather, emergencies, route changes, equipment failures, contamination rules, suspended service, or other circumstances beyond our control.

We may adjust take-out or return timing to accommodate a known schedule change. We do not guarantee that a third-party waste hauler will empty any bin or collect any overflow item.

If a bin is not emptied, we may return it, leave it at the collection point for a reasonable period, or coordinate another action with you, depending on safety, HOA restrictions, route limitations, and the selected plan. Additional visits are not included unless the plan or an approved resolution states otherwise.

7. Customer Responsibilities

You agree to:

Keep the service address, telephone number, email address, collection day, and bin count current;

Identify the correct bins and their normal storage location;

Place waste and recycling in the correct eligible container;

Close bin lids when required by the hauler;

Avoid overloading bins beyond manufacturer, municipal, or hauler limits;

Keep the path between the storage area and collection point reasonably clear, illuminated when necessary, and safe;

Secure pets and warn us about animals, hazards, surveillance systems, construction, loose surfaces, steep grades, or other relevant conditions;

Maintain valid municipal or private waste-collection service;

Provide working gate codes and lawful access;

Obtain required property-owner, tenant, HOA, or municipal permission;

Follow applicable rules concerning waste, recycling, bin placement, and collection;

Remove vehicles or obstacles that prevent reasonable bin movement; and

Promptly report a missed service or suspected damage.

You are responsible for fines, citations, rejected loads, contamination charges, or other costs caused by the contents of your bins, inaccurate instructions, a lack of authorization, or your violation of applicable rules.

8. Property Access and Gate Codes

You authorize Win City Bins personnel and contractors to enter the exterior portions of the service property reasonably necessary to locate, move, photograph, and return bins.

You may provide gate codes, lockbox instructions, callbox details, or similar access information. You represent that you are authorized to provide those details.

We will use access information for providing and administering service and will limit disclosure to personnel, contractors, and providers with a reasonable need for it. You must notify us immediately when an access code changes or should no longer be used.

We may skip or reschedule a service if:

An access code does not work;

A gate, lock, vehicle, construction area, pet, person, or other obstacle prevents safe access;

Entry would appear unlawful or inconsistent with your instructions; or

Conditions create a reasonable safety or property risk.

An inaccessible property is not automatically considered a failure by Win City Bins to perform the scheduled service.

9. Service Photos

You authorize Win City Bins to take photographs reasonably necessary to:

Confirm bin placement and return;

Document service completion;

Record overflow items or obstacles;

Document unsafe conditions or existing damage; and

Investigate or resolve a complaint.

Photographs may show bins, gates, driveways, curbs, yards, exterior portions of buildings, and nearby property features.

Service photographs are intended for operational verification. We will not intentionally use a photograph identifying a customer or private residence in advertising without separate permission. We may use de-identified or closely cropped operational images for internal training, quality assurance, insurance, or legal purposes.

10. Bins and Property Conditions

We will use reasonable care when handling bins and accessing property. Normal movement of bins may involve contact with pavement, curbs, gates, walls, gravel, landscaping, or other exterior surfaces.

You must notify us in advance of:

Damaged or unstable bins;

Broken wheels, handles, axles, or lids;

Fragile pavement, decorative surfaces, artificial turf, or landscaping;

Steep, narrow, uneven, wet, icy, obstructed, or otherwise hazardous paths; and

Any special handling requirement.

Win City Bins is not responsible for ordinary wear, pre-existing damage, latent defects, damage caused by an overloaded or improperly maintained bin, or conditions that could not reasonably be identified during ordinary service.

A claim for property or bin damage should be submitted promptly with photographs and relevant details so we can investigate.

11. Overflow and Additional Items

Overflow service is limited to the quantity and frequency included in the selected plan or separately approved by Win City Bins.

Unless expressly accepted in writing, do not present:

Hazardous, flammable, explosive, corrosive, radioactive, biological, or medical waste;

Batteries, fuels, oils, solvents, paints, chemicals, pesticides, propane tanks, or pressurized containers;

Hot ashes or burning material;

Needles, sharp objects, broken glass, or material likely to injure personnel unless legally and safely contained;

Human or animal remains or bodily waste;

Concrete, rocks, soil, construction debris, large appliances, tires, furniture, or unusually heavy items;

E-waste or other material requiring special disposal;

Illegal substances or contraband; or

Any item prohibited by the applicable municipality or waste hauler.

We may refuse any item that is unsafe, excessive, noncompliant, unusually heavy, likely to damage property, or outside the selected plan.

“Light overflow,” “miscellaneous items,” and similar descriptions do not override safety rules, hauler restrictions, or reasonable size and weight limitations.

12. Safety and Service Interruptions

We may delay, modify, skip, or suspend service when reasonably necessary because of:

Severe weather, flooding, fire, smoke, extreme heat, or another hazardous condition;

Unsafe people, pets, traffic, equipment, structures, or property conditions;

Government restrictions or emergencies;

Vehicle or equipment failure;

Illness, staffing interruption, or route disruption;

A utility failure or technology outage;

Lack of lawful access;

Suspected illegal material; or

Another circumstance beyond reasonable control.

Statements such as “rain or shine,” “never miss a pickup,” or similar marketing language describe our service goal and do not require personnel to work in unsafe, unlawful, or impossible conditions.

13. Customer Communications

You consent to receive communications reasonably necessary to establish and administer service, including telephone calls, email, and text messages concerning scheduling, access, service completion, photographs, support, cancellation, or billing.

Consent to receive promotional text messages is not a condition of purchasing service. You may reply STOP to opt out of promotional texts. Standard message and data rates may apply.

You are responsible for ensuring that the telephone number and email address you provide belong to you or that you have permission to use them.

14. Personnel and Contractors

Win City Bins may use employees or independent contractors to provide service. We remain responsible for administering the customer relationship, but nothing in these Terms creates an employment, agency, partnership, franchise, or joint-venture relationship between you and any service provider.

Customers must not direct personnel to perform unsafe work or work outside the agreed service scope.

15. Website Use

You may use the website only for lawful purposes. You may not:

Attempt to gain unauthorized access to the website, systems, accounts, or data;

Interfere with website security or operation;

Submit fraudulent, misleading, abusive, or unlawful requests;

Use automated means to scrape or extract website content without permission;

Impersonate another person or misrepresent authority over a property;

Upload malicious code; or

Use the website to violate another person’s rights.

We may restrict website access or reject requests associated with suspected abuse, fraud, security threats, or unlawful conduct.

16. Intellectual Property

The website and its text, graphics, photographs, videos, branding, logos, designs, software, and other content are owned by or licensed to Win City Bins and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, nonexclusive, nontransferable right to use the website for personal or internal business purposes related to evaluating or receiving our services.

“Win City Bins,” its logos, slogans, and associated branding may not be used without prior written permission.

17. Third-Party Services

The website and our operations may rely on third-party hosting, analytics, communications, payment, mapping, municipal, waste-hauler, or other services.

We are not responsible for the independent acts, omissions, availability, or terms of an unaffiliated third party. Your use of a third party’s separate service may be governed by that party’s terms and privacy notice.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as available” basis.

Win City Bins does not warrant that:

The website will always be uninterrupted, secure, or error-free;

A municipal or private hauler will empty a bin;

A third party’s published collection schedule will be accurate;

Every service photograph or message will transmit without delay;

Service will prevent every HOA notice, fee, citation, missed collection, or property condition; or

Service will be available for every property or on every requested date.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, Win City Bins will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost rental income, loss of use, reputational harm, or the cost of substitute service, arising from the website or services.

Except for liability that cannot lawfully be limited, Win City Bins’ aggregate liability arising from a claim will not exceed the greater of:

The amount you paid Win City Bins for the affected property during the three months before the event giving rise to the claim; or

One hundred dollars.

These limitations do not apply to liability resulting from Win City Bins’ fraud, willful misconduct, or gross negligence to the extent such liability cannot legally be limited.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Win City Bins and its owners, personnel, and contractors from third-party claims, losses, fines, penalties, liabilities, and reasonable costs arising from:

Information or instructions you provided;

Your lack of authority to order service or grant access;

The contents, condition, loading, or use of a bin;

A dangerous property condition you failed to disclose;

Your violation of law, municipal rules, HOA requirements, or these Terms; or

Your infringement of another person’s rights.

This section does not require indemnification for a claim caused solely by Win City Bins’ own negligence or misconduct where such indemnification is prohibited by law.

21. Suspension and Termination

We may suspend or terminate service for:

Nonpayment;

Repeated access failures;

Unsafe conditions;

Harassment or threats;

Fraud or misuse;

Repeated presentation of prohibited items;

Material violation of these Terms; or

Circumstances that make continued service unlawful or commercially impracticable.

When reasonable, we will notify you and provide an opportunity to correct the issue. Immediate suspension may occur when needed to protect people, property, systems, or legal rights.

Termination does not eliminate obligations or charges that arose before termination.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Before filing a lawsuit, you and Win City Bins agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution to support@wincitybins.com. We will attempt to respond within 30 days.

Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court with jurisdiction in Clark County, Nevada. You and Win City Bins consent to personal jurisdiction and venue in those courts.

Nothing in this section prevents either party from bringing an eligible matter in small-claims court or seeking emergency injunctive relief.

23. Changes to These Terms

We may update these Terms to reflect changes in our services, pricing structure, technology, or legal obligations.

The revised Terms will be posted with a new effective date. Material changes affecting an active paid subscription will be communicated as required by law and will apply prospectively.

24. General Terms

If a provision of these Terms is found unenforceable, the remaining provisions remain effective.

Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without our written consent. We may assign these Terms as part of a merger, sale, financing, reorganization, or transfer of the business.

These Terms, the Privacy Policy, an accepted service proposal, and any additional terms presented during enrollment constitute the agreement concerning the applicable website use or service. A specifically negotiated written agreement controls over inconsistent general language in these Terms.
